You
might recall that in 2006, the Libraries and Archives Copyright Alliance (which
I chair) reached an agreement with Ordnance Survey under which copies of parts
of its published maps could be copied by libraries and archives as if they were
covered by s39 of the Copyright Designs and Patents Act and reg 4 of the
library and archive copying regulations (SI 1989/1212). That agreement has now
been updated and replaced by a new one.
You
will know that maps are artistic works in copyright terms, and that the library
and archive copying regulations do not currently permit the copying of artistic
works, unless they are ‘illustrations’ to a literary, dramatic or musical work
that is being copied. Under the agreement, OS permits the copying of its maps
as if they were published literary works, under the library part of the
regulations.
The
agreement applies to printed mapping, and also the printing of maps from
electronic data, that is lawfully available to the public within the library or
archive.
The
conditions under which copies may be made are that:

the
librarian or archivist is satisfied that the copies will be used solely for
purposes of private study or non-commercial research. The agreement does not
require use of a declaration form for this purpose, though you may use it if
you wish. If you do use it, please note that you should use the library
(published works) form (form A in the regulations), not the archive
(unpublished works) one (form B);
·
only
one copy may be supplied to any individual. However, in ‘appropriate
circumstances’, for instance use in a thesis, OS is content for up to four
copies to be supplied;
·
only
a ‘reasonable proportion’ of a map may be copied. OS regards up to the
equivalent to the area of an A4 sheet (625 cm2) to be a reasonable
proportion;
·
the
user is required to pay for the copies a sum not less than the cost (including
a contribution to the general expenses of the library or archive) attributable
to their production; and
·
each
copy is accompanied by an acknowledgement in the form: © Crown copyright and
database rights. Reproduced by permission of Ordnance Survey®.

Libraries
and archives may allow self-service copies to be made on the same terms, in
which case a poster must be displayed by the copier. This is available from the
OS website, but please note that it must be printed in colour so as to
reproduce the OS logo and styling accurately. If you already have a similar
