There was a further statement from the FOM & SOM in Occupational Health ( at Work) Dec/Jan 09/10 issue.
‘Where a patient indicates that they wish to see a report before it is sent, the new guidance does not specify any time period that must be allowed before disclosure to the commissioning body (employer, pension scheme etc). Clearly, the concept of  ‘reasonableness’ must  be applied but the detail of good practice will be dependent upon a range of factors including the mechanism for showing the patient the report.(eg in person, electronically, by post etc)’
So I think you can set your own providing you can demonstrate the time allowed was reasonable. Eg  Unless we have heard to the contrary this will be forward to  ‘whoever’ within 3,10,14 days of receipt.

Now our Physicians have started to use consents, as per the GMC ruling , does anyone know if there is a limit to how long we wait for the employee to respond with a decision to release the report?

 

When we request GP reports, we give the employee 21 days to go and look at it if they indicate they want to see it first.

Is this the same situation? Can we put a time limit on it?

 

If they don't respond at all when it has been sent to them, does that mean we can never release it???

 

Glad to have any views or be pointed to appropriate guidance.
