I suppose the first question is whether the BBC have the confidential information.  From my skim read of the decision it would appear either they were given it by someone or that they were operating from the executive summary of the case.

 

Were they given a full copy of the Serious Case Review (SCR) or was it derived from the executive summary of the SCR?

And I note the judge was very critical of Doncaster for making the application, and refused to grant it "because there is no evidence that the BBC are threatening to publish any confidential information"!

Re the offences committed by two 11-year old boys in Doncaster

 

The High Court has refused an application by Doncaster Metropolitan Borough Council (Doncaster) to continue an interim injunction against the BBC restraining it from publishing information obtained from a Serious Case Review (SCR)

Case: Doncaster Metropolitan Borough Council v British Broadcasting Corporation [2010] EWHC 53 (QB), 22 January 2010.
