I'm not sure what the problem is here.  The PCTs are holding all supplies of H1N1 vaccine and are controlling who they vaccines are released to.  It is the responsibility of the PCT to ensure that the vaccine is distributed and given appropriately so I suspect that they will be the ones to deliver the vaccination programme as per the DH letter here http://www.dh.gov.uk/prod_consum_dh/groups/dh_digitalassets/documents/digitalasset/dh_107458.pdf

Subject: [OCC-HEALTH] Private OH provider and swine flu vaccination

Hi all
 
We have been asked by a council to do their healthcare workers vaccinations. The relevant PCT is all but refusing to do this for them. I am worried about indemnity both for the doctor (writing the instruction and the nurse administering the vaccs. There are many other issues to resolve before we actually get to the clinic but most are surmountable, however the issue of indemnity as we are a private OH provider is a worry. I have been in touch with the RCN and they say we are fine, however, I am not so sure?
 
Personally I would send them back to the PCT but I am not the one making the decision on this.
 
I would value any advice.
