It was often a joke in the days of ordering over the phone with your credit
card in our open plan office. Once the person had put the phone down having
given all their personal details and security number off the back of the
card we all chorused '"Thanks Bill, we're all going to book a holiday in
Florida now on your card'

Without delving too far into the legal topic of vicarious liability, the
obvious point here is that it is not part of (most) employees jobs to
provide such information so they would be acting outside the terms of
their employment - so no liability.

This would apply whether it was their own or someone else's personal
data e.g. I may know a colleagues bank account details because he wrote
me a cheque for something personal. If through some spam to my work
mailbox I was persuaded to pass that on to a third party my employer
would not be responsible and  equally I cannot claim if I divulge my own

I would say it could depend on what the Council says about its
filtering.  
If it says that it is 100% successful at blocking badstuff, then they
could be in trouble.

But what you'd hope they say is that they make a best effort attempt,
but users should still be vigilent and report dodgy activity to
technical support channels.  Which is common sense anyway, but hey,
litigation is often a tool used to make up for a lack of common sense.
