I would say it could depend on what the Council says about its filtering.  
If it says that it is 100% successful at blocking badstuff, then they 
could be in trouble.

But what you'd hope they say is that they make a best effort attempt, but 
users should still be vigilent and report dodgy activity to technical 
support channels.  Which is common sense anyway, but hey, litigation is 
often a tool used to make up for a lack of common sense.
