I have taken this to mean any notice that is prescribed in regulation 15
of, and schedule 3 to, the Contaminated Land (England) Regulation 2000.
E.g. remediation notices; notices relating to the designation of land as
a special site; notices relating to termination of designation as a
special site.
 
I'd be interested to hear what others have decided is a notice for this
purpose.

Subject: CON29 Contaminated Land notice


Could somebody please clarify for me what is meant by a contaminated
land notice in the CON29 question 3.12a:
 
3.12 - Do any of the following apply (including any land adjacent to or
adjoining the property which has been identified as contaminated land
because it is in such a condition that  harm or pollution of controlled
waters might be caused on the property)
a) contaminated land notice
b) in relation to a register maintained under section 78r of the
Environmental Protection Act 1990:
    i) a decision to make an entry, or:
    ii) an entry
c) consultation with the owner or occupier of the property conducted
under section 78G(3) of the Environmental Protection Act 1990 before the
service of a remediation notice?
 
 
Do they mean has the site has been determined as contaminated land, in
which case an entry on the register would be made (which is covered in
part b of the question) or do they mean an actual remediation notice? We
are having quite a few queries about this and no one seems to be clear.
