Dear all,
LONSAS has an information page advising freelance arts
educators and employers on the subject of employment status. Much of this will
be applicable to other employers and freelance workers in other settings.
The page can be found here: http://www.lonsas.org.uk/content.asp?CategoryID=852

I am self-employed but when I
lecture at a particular university once or twice a year I am classed as an
employee, this is the same for the occasional courses I teach for the
WEA. It doesn't seem to be a problem for me, I just pass the payslips to
my accountant with all my other invoices and so on and she works out how much
tax I need to pay at the end of each financial year taking into account what
tax has already been taken by those organisations. Perhaps if you do a
self-assessment tax return this is more difficult.
it's not that easy being
self-employed and we don't have any of the benefit perks of being an employee!

My tame Tax Inspector sent this link from HMRC notes. http://www.hmrc.gov.uk/manuals/esmmanual/esm4504.htm
It relates to lecturers/freelancers/part-timers in FE and
universities, but the criteria for defining employed status/freelance status
and part-time status are of interest, and transfer across to the museum and
gallery sector.
The HMRC notes support the point of view suggested by Tehmina
and other recent respondents.

Thank you to all those of you who
replied to my question about payment of freelancers. The consensus seems to be
that following guidelines from HM Revenue it is common practice to put
regularly used freelancers on the books but one off events can still be
suppliers
Many thanks
Paul
