I wonder if anyone knows under what powers the IC makes this declaration a condition of Registration?

A public authority has to register the fact that it is a public authority as part of the registrable particulars.

 

Check OIC register of data controllers.

 

If not registered, might get more interesting!! (but there are reasons why registration is not needed – before we jump to conclusions)

It is interesting that you have queried if an organisation is a public authority. I recently tried to find out if an organisation, not Amnesty, was a public authority, and the Ministry of Justice confirmed to me that there was no up-to -date definitive list of public authorities. The only recourse is to ask the organisation and rely on their answer.

 

Apparently Schedule 1 of the Act is the only list at present. available, unless someone out there knows differently,
