I think it comes down to the very real responsibility to limit access to
confidential information to those who genuinely need to know it.  Since
the DPA refers to "lawful" processing of data, if there are laws
regarding confidentiality that hold sway here, then breaking those also
breaks the DPA where that data is concerned

There is an argument which might be put forward after "baby P" that
could suggest that the manager was correct in monitoring work in this
manner, but there are far more relevant and effective mechanisms for
monitoring the performance of work by staff than reading every email.

The new general manager is a fool, of course, who will alienate every
staff member immediately.  And, if they all decide to "work to rule"
they can cripple him in about 20 minutes!
