This has been endlessly discussed in England and Wales. You will find much on here if you search and good summaries can be found on PSF - latest at http://www.publicsectorforums.co.uk/page.cfm?pageID=5200  - you will need to register (free) if not already done.
 
Bottom line is you are almost certainly on a loser. The real issue is whether they have the power - I think it is pretty clear now that they do (unless your legislation is v different). Once they have the power consent is pretty much irrelevant* - but you should deal ( as a matter of good practice although probably not a legal requirement* ) with fair processing as required by Schedule 1 - we have annual notices on payslips and other channels.

Your comments would be much appreciated.  Audit Scotland are about to data match employee details for the purposes of the above.  However, they are asking for all bank details.  A great number of employees have expressed concern (including myself) as I believe this is much more information than is required for the above purposes.  If a member of staff is found to be committing fraud then I can see on an individual basis that they could request such details if the fraud is being investigated.  Audit Scotland are saying the details are mandatory but I think this is more than is required for the above purposes.
 
Also, I am of the belief that if individual members of staff object to such details being released then I believe the Council have a duty to adhere to their wishes.  I think with all the data losses that have been happening recently has triggered this off.
 
I would be most grateful for any comments.
