I think it would be difficult to provide evidence rather than opinion that wearing the muffs didn't "cause" the seizure (However I do agree with you) . In my organisation this would be likely to end up in litigation, I think the winner will be the side with the most skilful legal representative rather than the accuracy of the facts. He came to me saying that he has worn his earmuffs with a gap at the bottom and has now been told to wear them covering his ears and he felt that this would cause him to have a seizure as he has been feeling dizzy. I explained that I thought this was unlikely and his symptoms are more likely to be caused by the incorrect positioning of the earmuffs. I provided him with a different set to try, educated him on the correct wearing position and gave him a leaflet to take away (which I saw him put in the bin outside my office) Taht afternoon he had a seizure on the factory floor including loss of bladder function! I have seen him today and he is saying it is because he couldn't wear the earmuffs with a gap and it is mine and the managers fault for making him do this and watching him. I explained that I thought the fact that he got stressed and worked up about the issue was more of a trigger than the earmuffs. Your thoughts??
