Hi Frank

The Egg shell skull principle (reasonableness of precautions, special duty of care) came from,  Paris v Stepney Borough Council (1950).

Hello Frank

This relates to the “egg-shell skull” principle. It will be in Kloss and a search on Google may assist.

Morning all,

I have a vague memory (on a good day) of reading something about having an increased duty of care for employee's with reduced hearing thresholds and for the love of money as per usual when I want it I can't find it.

What brought this to mind is I have a number of employees who are category 3 and it was suggested by one of them that maybe we should provide them with higher specification of hearing protection though the argument against this is that the current ear muffs have been assessed as adequate for the environment.  While the attenuation levels may be adequate for the average employee with no hearing loss will even the reduced levels from the current protection be enough for those with a loss already?

I will drag out my books over the weekend but I am away from home at present and I would appreciate your thoughts and any references on the subject.

Many thanks

Frank
