Dear Clare,

My first thoughts are similar to yours, that his seizure may have been
stress induced. However, I would still write to his Specialist, enclosing
the information of the ear defenders you provide and ask him for his
expertise, assuming you get consent from the client.
Is there a reason why it is mandatory to wear the ear muff defenders you
routinely provide? a reasonable adjustment in light of DDA may be for him to
be provided with other suitable ear protection.
If not, then as per many other emails on health surveillance, this may
become an manager/HR issue, for non compliance of H&S legislation.
Good luck Suzanne

Subject: [OCC-HEALTH] epilepsy and earmuffs

Hi all
Opinions please:
employee with epilepsy working in food production factory. Factory policy
now to wear mandatory ear muff style defenders. He came to me saying that
he has worn his earmuffs with a gap at the bottom and has now been told to
wear them covering his ears and he felt that this would cause him to have a
seizure as he has been feeling dizzy.
I explained that I thought this was unlikely and his symptoms are more
likely to be caused by the incorrect positioning of the earmuffs.
I provided him with a different set to try, educated him on the correct
wearing position and gave him a leaflet to take away (which I saw him put
in the bin outside my office)
Taht afternoon he had a seizure on the factory floor including loss of
bladder function!
I have seen him today and he is saying it is because he couldn't wear the
earmuffs with a gap and it is mine and the managers fault for making him do
this and watching him. I explained that I thought the fact that he got
stressed and worked up about the issue was more of a trigger than the
earmuffs.
Your thoughts??
Clare
