I suggest you stickl to the facts and avoid getting into a back and forth discussion with him.
Then hand it back to management.
 
Sounds like it may actually be a bit of a smokescreen for frustration about his change of run

Re your other guy would company be willing to fund private appointment to see Orthopaedics earlier?  I presume GP is signing sick notes after this length of time, is it worth giving him/her a ring and suggesting alternative duties available for this guy.  I may be making suggestions you have already tried; don't know if that is of any help, Regards Annie.

Subject: [OCC-HEALTH] CVA and HGV Driving / Consultant saying not to go back to work

Dear List
I have a chap who had a CVA in 2004 and received his HGV licence back the year after. This has just been renewed again for 3years. His run have changed so there is the potential that he may be 1/2 to 1 hour later on the road and he has expressed the opinion that he cannot undertake this as his eyesight will be affected. The initial CVA affected his vision but not much else. His vision is within acceptable limits, otherwise he would not have passed his HGV assessment, however he wears contact lenses.
He has been given advice about the use of contact drying the eyes and making them potentially feel more tired and gritty at the end of his shift, but he insists that his eyesight will deteriorate significantly with the potential extra hour. This increase is not in run time etc but is dependant upon traffic factors etc.
Have I missed anything important here...is he more likely to be affected by these things as he has had a CVA previousley?
Also have a chap that we think could return to clerical duties (absent with bursitis to his hips) but states his consultant has told his not to retrun to work until, he has seen the Orthopods.....appointment in 3 months time and he has been absent for 6months so far following hernia repair. Where do you stand if a Surgeon is saying not to go back until you have a specialist opinion from another speciality but OH feels he could RTW on laternate duties based upon his symptoms and abilities etc.
