Hi Clare I recently had to approach the MDU about an issue of Data Protection. While I was on the phone I asked about the issue of third party reports, as colleagues of mine were debating this issue. I was told that the reports are part of the health records and should be submitted to the lawyers as such. If there is a third party mentioned in the report, you have to get the third party permission to release this or omit the part which will identify them. I've just had a request adn appropriate consent for release of medical notes, records etc froma lwyer in respect of a personal injuries claim of a memeber of staff of one of my contracts. I new the individual was possibly going to claim, so it wasn't a total surprise. What I need clarified is - - am I right to included the reports received from his GP & Specialist, and if so do I need their agreement to do this.
