 We do something similar, although the emphasis would be on getting a
reason for refusing the request from the medical person involved, e.g:

tient name and address)

Access has been requested by ................................ to view
the health records of the above patient, under the terms of the Data
Protection Act 1998.

Please check the section relevant to your care and treatment of the
patient, and sign below if you give consent to this request.
Photocopies may be issued to the applicant if they have requested them.

If you do not feel able to give consent, please indicate your reasons
for withholding information.


I agree/do not agree (delete as appropriate) to the release of
information as requested by the applicant.

If release is declined, then this is sent on to the Trust's Data

I would have thought you would have to write to the GP to get his
consent as we do here if we have any medical reports held on record - we
usually write and obtain consent from the medical practitioner.  There
could be information on his record that could cause harm/distress and I
am certainly no medical expert and therefore would not make that
decision.

One for all you fellow HE types out there. Any comments/thoughts on the
following scenario gratefully received...

A student due to take exams here is affected by illness.

The student gave our support team permission to approach their GP for
relevant medical details. This we did, obtaining the info direct from
the GP.

Now the student has asked to see these records. What parts of which laws
might apply? (I'm particularly concerned that there's probably specific
legislation relating to medical/health records that has an influence
beyond the terms of the DP act..)
