Dear All,

 

A manager concerned regarding corporate manslaughter asked me if he is protected by an OH report passing an employee fit to return to driving following recovery from a recent episode of alcohol abuse. I advised the manager that I believe he has followed professional medical advice and as long as any adjustments are adhered to then the manager has fulfilled his responsibility. If the employees line manager has any concern about the employees fitness to drive then the person should not be allowed to drive and re- referred to OH.

 

I advised the manager the OH professional is likely to have obtained a GP report and recent LFT’s and blood alcohol levels, to have clinical evidence that the employee is not currently taking alcohol.

 

Does anyone routinely carryout breathalyser tests on LGV drivers or in the case of the employee above it seems a routine breathalyser would ensure his fitness to drive.

 

Any thoughts or advice, greatly appreciated.
