At Oxford we make it quite clear that health surveillance is required by legislation (usually COSHH), and is therefore mandatory.  They are clearly told that failure to attend appointments will automatically lead to exclusion from the area of risk, even if this exclusion means interrupting their research or other activity. Consent forms are therefore not required by us.

Does anyone have such a thing as a consent / decline form for health surveillance.

Our health surveillance forms have the consent on the bottom, but we do not have a form that empoyees sign to state that they DO NOT consent to particiapte in health surveillance. We have always relied on the approach that telling them if they do not undertake health surveillance we are unable to assess and report them as fit for duties, and this has mostly worked with reassurance on confidentiality etc.

However we have taken on a contract where the employees are extremely suspicious and several have refused to attend OH for health surveillance. One chap attended and refused to complete the questionnairres or undergo spirometry despite all the above and so HR were informed that we could not pass judgement on his fitness as he declined to undergo health surveillance. This was all noted in his OH notes. HR removed him from his role and into a non-exposure line of duties and he then stated that the OH nurse was lying.
