I am finding that it is necessary to have these protocols and the DP
officer should be involved at the outset. I am finding that the
Council, NHS and Police have a data sharing protocol but each new
project is about a different piece of work and therefore do the current
forms inform individuals that we will be sharing with NHS/Police - does
the notification include this and does other legislation which states
that we have to share information give us no option. I have found more
and more with these things that i.e. DP, Human Rights and other
legislation may take precedence..

Simon,
I'd agree in the most part...but the protocol is also going to cover
information being shared by our PCT's, District councils, Voluntary
organisations and a few other bodies who will be providing the
information to us so we can compile a map of these vulnerable
individuals, along with any care needs that they made have, e.g..
Dementia, or wheel chair bound. This will need to be done before any
emergency happened so I don't think we could rely on DP too heavily.
Does that make sense? I wouldn't want to waste time putting an ISP
together if I don't have to.

I may be misunderstanding the need for a protocol here, but is one
necessary?
Are you sharing data regularly or is it to cover the provision of
information when an emergency is declared?
If it's the latter, then I would question the need for a protocol in
terms of management overhead and general overkill.
I am of the opinion that protocols/policies and procedures are fine
where they are needed, but there is too often a view of "aye up lads, we
need a protocol". Before we know it we'll be in the position of H&S.
If it's for the provision of information to police in an emergency
situation only I would be looking towards the relevent schedule in the
DPA and building acknowledgement that this will take place in other
documents such as information security policy and/or fair processing
documents, perhaps.
Just thinking out loud - happy to be shot down on this...
