The UKIC has stated previously that a minor who is capable of understanding the implications of informed consent may lawfully give that consent or make any other personal data related decision.  This is unlikely in practical terms to go far below 13 years old, but may do.

In Scotland there is a law that specifies the Age of Minority, I believe.

Agreed.  In online matters, a rule of thumb (and no more) is that a minor over 13 can give consent. The US has the COPPA legislation (for online matters) which enshrines a 13 age capacity.  There is no direct law in the UK, I believe, but there is law on giving consent to medical treatment (remember the Gillick case of some years ago now).

By and large, unless you are doing something rather unusual, it would be reasonable to assume that anyone competent enough to fill in such a request is competent to understand the privacy implications - assuming you have a customer friendly FPN. If you also have easy means of opting back out / amending preferences I would not be worrying unduly about this.
 
For most DP purposes being a minor is not significant in itself - it is the capacity to understand.

Can anyone please clarify what the rules for processing personal details of an individual under 18?

 

This is the situation – we have an online mailing list linked to our CRM system which invites customers to receive regular updates on park news and activities.  The standard processing form asks customers to fill in a list of their interests as well as address, contact details, ethnic origin for monitoring purposes, with a standard fair collection notice and privacy policy at the bottom of the form.

 

We occasionally get completed forms from minors – are there any special rules or exceptions which are different from processing the details of an adult?
