So far as I am aware only Sec. 3 Para 1(f) is still in force of the Access to Medical Records Act, the rest being superceded by the DPA/FOIA. I seem to remember that there was some talk of "recommending" that NHS (and possibly other health org's) worked towards 21 days where possible in order that processes and systems were consistent across DPA and FOIA obligations (lowest common denominator). Would have been better if the intelligencia defining the acts had made everything consistent. From my minimal involvement in drafting changes to legislation I suspect that it was a couple of guys sticking their fingers in the wind and generating a random number of 21 without even considering the ramifications of other acts.
