• Clear u-turn from previous advice about whether listing someone as an attendee in minutes is personal data - section 6
• section 6 and 7.1 : if you read these carefully you will spot what appear to be internal inconsistencies. Also of concern however is that this is a direct challenge and contradiction to Durant. So as a DPA officer which do I follow : ICO or the Court of Appeal ? Just one example : part of Mr D's application was for "copies of telephone attendance notes". Clear decision of CA these were not personal data. However they clearly satisfy the test at the top of page 13 (ICO). Paraphrasing only slightly "the attendance notes will have biographical significance for the individual in that they record the individual’s statements made at a particular time ". Unless "what I say" is somehow less personal than "where I am" when I say it   .... not in my view
• I find the whole of Appendices C and D contradictory and muddled. As elsewhere in the guidance the ICO starts appendix C by advancing the proposition that if it is unlikely that someone else  could identify an individual from anonymised data then  the individuals are not identifiable, despite having just recited the directive which, like the Act , makes it is clear that it is enough if they are identifiable to the data controller. This confusion is entirely unnecessary - as the issues under FOI (appendix D) should really be kept separate. 1. Is it personal data even though I have anonymised it - the answer , in my hands must be yes unless I have done it in a way that even I cannot reconstitute the link. 2. can I nevertheless disclose it under FOI. Surely it is here that the question of identifiability by a third party comes in - when judging and balancing against legitimate interest of requester ,for example , whether the rights of the subject may be prejudiced. If possibility of identification is remote disclosure may be easy. It does not however mean that I am not processing personal data at the point of disclosure.
