Certainly admissible as there are no longer artificial rules about this and if the originals are ashes it would seem unlikely a court would not accept the copy as best evidence.
 
What are the risks involved ? Is anyone likely to challenge the content ? If so advisable to keep some proper record of the copying process and have the copy certified as true and correct by a lawyer.
 
If not - and most disputes are about interpretation not about what was physically signed - a lighter approach would probably be fine.
 
Why not scan them to a secure location (an EDRMS would be ideal ! ) using a BIP0008 compliant process instead ? That should be a perfectly acceptable back up.

Dear all,

 

I’ve had a query from one of our departments asking for specifications for fire-proof filing cabinets in which to store original contracts.  I’m not entirely convinced that this is necessary, and am considering advising instead that they ensure copies are made and stored elsewhere.  I wonder, though, whether there may be a question mark over the legal admissibility of the copy contract, which sort of defeats the object!

 

Any thoughts?
