Neither answer is really right or wrong. As long as you can justify the
length of time you want to keep the records, which I think you have in
the first case, I would say that you are ok to keep them for that long.
ICO may think it is being excessive, as they have no teeth and any fine
from them is likely to be far less then any action taken under tort I
would go with the first.

Hi Al,

I'm currently having a debate on the retention period for Education
Welfare Service Records (EWS).  I feel they should be kept until the
child reaches 25, based on the 6 year time-bar for actions of tort based
on s.2 Limitations Act 1980 (taking into account a child can not bring
an action in their own right until they reach 18)

However I've been told that the ICO feels this is excessive?

I have been advised by our local Policeman that records should be
retained until the child reaches 21st birthday - which I can only guess
is based on personal injury time-bar of 3 years based on s.11 of the 82
Act?

I'm interested in how long other authoritys keep EWS records for?  Any
help would be much appreciated.
