This is indeed a concern.. and much has been
talked about it on BAJR.. when first reported.
I would draw peoples attention to Simon Colcutt's
comments and to some real cases, with replies..
To force a reply from the MoJ looks like
a problem.
Considering this answer to one request for
clarification
.."Certainly, the MoJ did not give me any useful
advice whatsoever, either written or verbal, when I consulted them over a real
case, beyond “it may be (legal) ... on the other hand it may not be ...”
equivocation."...
