I'm not aware of anything that actually prevents organisations from setting a short retention period, so I don't see why we would need a "defence". As long as the information is kept for long enough to satisfy the purpose for which it is obtained, there is no long or short. If we needed CCTV footage for no longer than 48 hours (e.g. we only need it to see what was recorded if there was a break-in), then what's wrong with that? You really must have one, and it must refer to the classes of data held. Without it I believe it can be shown that a short retention period is questionable. I believe we hold our tapes for approximately 31 days. How does this accord with the Data Protection Act when a subject access request is made i.e. 40 days. We're not the only Council who does this, some only hold the tapes for 28 days. I can't remember if this came from the guidelines from the IC's Office but it seems totally against the data subject's rights according to the Act. TGIF.
