'Confidentiality' RCN Guidance for OHN's and Section 5 of the NMC Code
of Professional Conduct.

Dear Neil and all,
I would be quite concerned about storing
information in a filing cabinet that can be accessed by the H&S
manager, even if he is your boss.
If there is no need of the administrator to
access, then they should not have access. You can get the administrator to sign
an appropriate confidentiality agreement , if they need to access files to
arrange your diary for example, but the person needs to be quite sure that they
can show the stuff to no-one except OH people. Even if the managing
director threatens them with the sack.
And if you haven't got confidence in
that administrator being that strong, don't risk it.
Because you are
responsible for that medically confidential information, which is "sensitive"
under the Data Protection Act.
If I were an employee of your company I
would not be happy about those people having access to that sort of information,
even if they never tried to do it.
As for a secure computer, well
,if they can access it it doesn't sound as if the data is held
securely.
A good reference book for this is Diana Kloss
"Occupational Health Law". Buy it with your own money if necessary and keep it
near.
