I think that looking for conspiracies is unnecessary. The basis for the agreement will be the licence for pubic service organisations that can be found on the CLA website. I also think that it is quite right that the licence covers the NHS retrospectively, as this allows those trusts who took out a licence to be reimbursed and also covers breaches the copyright law that would have occurred in the NHS over that period of time. Personally I think that this agreement is here to stay.
