Yes, but there are a number of issues relating to CC licences...for example.. 1) The CC licences do not contain any terms which protect the material under which it is licensed from being used within an obscene, libelleous defamatory context 2) You can't issue material under a CC licence which contains third party material (unless you have permission, you own the rights or it is out of copyright) 3) It is really important that any UGC that is inputted to the site via a CC licence, is then made available to other users under a CC licence (i.e. CC licences are not intended for use within closed forum, they are meant to permit material to be used freely by all) 4) Always read the small print of the licence and make sure that the licence does what you want it to do.......CC licences like any other LICENCES need to be fit for purpose My sense is that it is a risk to collect UGC content without careful thought not only about copyright, but other rights and legal issues which might present risks for your organisations if you republish (such as the shortcomings identified in my first point above). So, in these cases, it is really important to use robust terms and conditions controlling the submission of material (which will not require the User to assign their copyright). It is also helpful as a means to provide them with clear guidance about what is suitable and appropriate for submission (and what is not). In this case, I think that the use of CC licences is just too risky and certainly not fit for purpose A factsheet including what CC licences are and their use within and by cultural heritage organisations can be found on CollectionsLink (www.collectionslink.org.uk) I hope that is helpful Naomi Naomi Korn Copyright Consultant Tel: (020) 8886 1764 Mobile: 07957 761 032 e-mail: [log in to unmask] website: www.naomikorn.com The information contained in this e-mail and any attachments is confidential. You are right that this needs to be built in at the start!!! Additionally, where we've been collecting UGC via the website, I've used the following statement: "In submitting your story, you agree to grant the Science Museum a non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution." The key thing with copyright for user generated content is that users should not be expected to sign over their copyright on their content, which would forbid them from publishing it elsewhere. Instead they should retain the copyright ownership, but grant you a non-exclusive licence (so that they can also licence it to other people) to use their content. If this right is sub-licenseable, then you can reserve the possibility of syndicating or sharing the content with other websites.
