My understanding has always been that if each person makes their own photocopy from a hard copy original, this does not break copyright law. However, it is illegal for one person to make multiple copies on behalf of others, or for a librarian to make multiple copies of an article, knowing that it is for use in a journal club, even if each of the requesters has signed the copyright declaration form. (In your defence it would be a little unrealistic to state that you had made 20 copies of an article for the members of one department & sincerely believed that none of them had mentioned to anyone else that they were getting a copy.)
 
The major difficulty is getting people to realise that it's OK to make your own copy, but illegal to make a copy for someone else as well as yourself and that it's also illegal to make a photocopy from a photocopy.
 
In my experience, it's impossible to restrict journal clubs to those articles available online. The journals that they want to discuss here cost a lot of money to obtain online and aren't available as part of the NCC. Small specialties really miss out on electronic access!
 
Our Trust decided to take out a Copyright Licence, but this only covers journals to which our Trust has a subscription.

It's library privilege copies (ie copies made on behalf of someone else by a librarian) where they have to declare that noone else with whom they work or study is making a copy which is why the library can't make multiple copies.
 
For journals clubs an individual copy is being made under the fair dealing exemption "which includes research criticism and review"

and is not breaking the law in my opinion (but I'm not an intellectual property lawyer of course!)

surely they can't each make their own copy as no-one can copy because to the best of their knowledge no other person with whom they work or study can make or intends to make a copy.
 
But, I am given to understand that if they can each download it for themselves then this is different as each copy is recorded as being downloaded by the service provider.

The possibilities I can think of off-hand:
 
1) Each member of the club makes their own copy - easiest if the journal's available electronically and the coordinator can send out a link.
 
2) Coordinator contacts the journal directly and asks permission.
 
3) Coordinator (or library on their behalf) orders correct number of copyright fee paid copies from the BL
 
There may be a cost with no.2 and there will be a quite substantial cost for no. 3.
 
Any more ideas?
