I may add to this that indeed both ingenta, and Wiley claim to deliver 
COUNTER compliant usage statistics on their website (ingenta in their 
Library services summary brochure, Wiley in their product brochures 
on the PRODUCTS AND SERVICES FOR LIBRARIANS website) while 
they are de-facto no longer COUNTER compliant. The same with Swets. 
Although the current scarce intro on the SwetsWise website does not 
explicitely mention COUNTER compliance, other older online brochures 
still available on the Swets website do so, cf.

"The reporting tool is also fully compliant with the latest “COUNTER” 
industry standards and can be easily merged with other data. Need a 
report for a presentation or meeting? Simply select formats that will 
organize your data in a readable fashion" - the German version 
explicitely refers to a "level 2" compliance, and there is an old Swets 
Blackwell press release stating that Swets is the "First Subscription 
Agent to Achieve COUNTER Level 2 Compliance". Unfortunately, 
this was level 2 of the former release 1, not release 2 as one might 
think. Also a November 2005 press release in connection with SUSHI 
prominently featured COUNTER compliance while Swets only a 
month later ceased to be COUNTER compliant. This is certainly 
misleading, and all three vendors should be required to make a 
prominent note that they are currently NOT COUNTER compliant but 
strive to regain COUNTER compliance, if that is what they do, 
hopefully.
