I understand there was something like 1600 complaints and the original
enforcement notice was ignored.   It's likely that many Local Authorities
produced witness statements from electoral registration managers about
whether the individuals who had complained and who voted in their area had
"opted out" of the registered version of the register with the date of opt
out.   I'm surprised it didn't go anywhere.  
 
However, ICO will always take into account how "harmful" a disclosure is to
the individual and the nature of the info disclosed so if the website was
closed down it was a result!

An enforcement notice had been served.  There was evidence.  Investigating
officers had colleted formal witness statements.  I know, for I was one such
witness.

This is assuming that the case was likely to succeed and had sufficient
evidence?

It clearly needs to go further, just a question of why it was dropped.
The UKIC do appear to have gone to some trouble investigating complaints and
I would have thought that they are frustrated that a conviction has not been
raised.
