Section 78R of Part IIA deals with the Statutory Register and sets out what
things we're obliged to put on it. Which is things like remediation notices,
remediation statements and prosecutions. However there is nothing stopping
you adding additional information to the register, such as Determination
documents. See the LA guide for more details on what you might include.

Subject: Contaminated Land Determination and Public Register Query


I am about to determine one of our landfill sites as contaminated land and
have been informed by our legal team that the determination only goes on the
public register after service of a remedial notice. I thought that as soon
as the determination is made that it is placed on the register, which seems
to be make sense as service of remediaiton notice may not be necessary.

Can anyone confirm the part of the guidance/ legislation that states when
the determination document is placed on the public register.
