That I wouldn't consider as being "on the employers time", as long as it 
was outside normal hours, of course. Sometimes this gets blurred if the 
Xmas party is at the end of an "awayday" that is virtually compulsory.

That I would consider as absolutely "on the employers time", and any 
pictures taken should be part of the "acceptable behaviour" agreed 
between employer and staff. Of course, if the event is an exotic one, or 
perhaps overseas, the acceptable behaviour for the employee in the local 
circumstances might be quite laxer than the acceptable behaviour back 
home!
