You are lucky to have had a reply to your section 10 notice. Ah wait. So
did I. I was told I could unsubscribe from receiving text to voice messages
by dialling a number.

When I work with my clients and when I speak at public seminars I take great
pains to emphasise "Any Data Protection matters must go immediately to the
Chief Privacy Officer for their personal attention. If you are not that
person you may not answer them. You are not an expert and you are not
empowered to make any answer."

I pressed my section 10 notice home telling them that their reply was an
irrelevant reply, that my notice stands and that time was ticking away.

The very nice manager packaged this up and sent it to legal. We await
results with wry amusement.

We are also going to be circulating this interesting little(!) farrago as an
item in our next newsletter, and I'll update it on our website when relevant
with whatever the outcome is.

After I got a reply to my s10 Notice saying "I can confirm that I have
changed your telephone number to ex-directory. Therefore your details will
be removed from the Directory Enquiries services with immediate effect. A
letter will be posted out to confirm this.", I reiterated what a s10 notice
is, how they are breaching the Act and that they still have 4 days before I
take the matter to UKIC.

We'll see what happens.

I have just spoken with the very nice manager in BT Customer Service. He
packaged this issue and sent it to BT Legal on Friday. He hopes that the
fact that he has not had an answer means that they are taking it seriously
as an issue. He has kindly given me his direct number. He, at least, is
taking this seriously.

I mentioned to him that various blogs were starting to come online and be
picked up in Google. He is going to add that information at around 3pm to
stir the legal team up a bit.
