S10(3) of DP states 21 days from date of receipt for requests to cease processing.

It makes no mention of working days or otherwise so I would assume as with Tim's view that its elapsed/calendar days rather than working days.

My firm impression was that cessation of processing was elapsed days also.  Now the problem with firm impressions is that they persist until corrected!  This means we need one of those "It says 'this' in 'that' section" people to look at this and disabuse one of us, please :)

That's true for provision of information, but I thought that for requests to cease processing it was "working" days.

Just throwing that in for clarity (not related as such to Doreen's original point)  and confirmation  - if I have this wrong.

Clare

I have always understood that DP elapsed times are calendar days of whatever sort.  Thus the very worst time to receive a SAR is 10am on Christmas Eve.

Perish the thought but...for the purposes of DP/FOI, I'm sure I've asked this before.  The Council is closed from 24/12 and will not be open again until 3/1/07 - is it only Xmas Day/Boxing Day and New Year's Day and the day after we can treat as public holidays for the purposes of days to respond.

Sorry folks in England and Wales (not sure about Ireland) but yes, we get an extra day at New Year!!!!
