You are entering a mine field! i.e. the state aid regulations, but there are
a lot of them and they will not necessary help you! You need to look at how
public resources are defined. There are two principles to be considered
(a) the source of the funds and
(b) who controls the funds

You will be referring to the money being used by Orkney and Shetland
Councils. Unfortunately I have rather a lot of experience of the situation
in Shetland and of challenges under the state aid regs e.g. on purchase of
fish quota. You could try to read the Commission 's verdict on that case but
it might leave you more confused!
If you have some specific queries I could try to answer them (but I do not
guarantee it!)

Dear all,

I have heard that some local authorities have a special fund for monies paid
in by the oil industry. However, these monies are not government funds nor
funds sourced from enterprise organisations or local taxation. I am trying
to find out whether there are any constraints on the use of these funds to
support local start-ups or existing businesses that wish to expand? I
understand that the EU has a body of law designed to create a level playing
field and avoid "subsidies" which would distort competition.  Would anyone
be able to point me in the right direction of this EU legislation?
