You need to look at how public resources are defined. There are two principles to be considered (a) the source of the funds and (b) who controls the funds You will be referring to the money being used by Orkney and Shetland Councils. Unfortunately I have rather a lot of experience of the situation in Shetland and of challenges under the state aid regs e.g. on purchase of fish quota. You could try to read the Commission 's verdict on that case but it might leave you more confused! If you have some specific queries I could try to answer them (but I do not guarantee it!)
