There are still several bits of the Act that have not been repealed such as allowing access to:

where the patient has died, the patient's personal representative and any person who may have a claim arising out of the patient's death.

I think most of the Access to Health Records Act 1990 has been repealed
because of DPA 1998. The only remaining bit gives people who want to sue for
negligence the right to see relevant bits of the deceased's health records.
A public authority which receives a request for information about a deceased
person therefore has to treat the request as an FOI request. I agree with
Tim Trent that a duty of confidentiality may exist even after a person has
passed away, and a bunch of exemptions might suggest themselves anyway, but
a request for information about the deceased is an FOI request.
