I should add to this that I'm excluding "subjective comments" along the
lines of "I deliberately marked his exam paper down" and similar
admissions of wrongful conduct by the commentator, as there is obviously
a risk then. Just in case any smart alecs are up and about this morning.

An interesting one this. Can anyone suggest the reasons why people would
not want to put subjective comments on a record? I would guess the
reason the clinicians stopped doing it after the Access to Health
Records Act is because it's just embarrassing rather than a legal
liability. I can't really see any comment, no matter how inflammatory,
leading to any form of litigation risk if it were seen by the subject.
"See, my teacher always hated me" isn't the basis of any tort that I
know of. However, I am happy to be corrected on this - what do you have
in mind as a "litigation of bias or inequity"?

With the increased use of our student record system in the college,
staff are wanting to put down subjective comments about student
behaviour. They want to 'warn' other staff so they consider future
applications more carefully. Something doesn't ring true with it and my
thoughts go towards a DPA request for personal details that may open us
up to litigation of bias or inequity.

 

How do other organisations deal with this? Are there any implications of
letting staff enter free-for-all comments that aren't monitored?
