There is nothing to stop the question from being asked. Thee is also nothing to compel the person to answer at all, nor does the time clock stop running -----Original Message----- From: This list is for those interested in Data Protection issues [mailto:[log in to unmask]] On Behalf Of Clementine Amawo Sent: 29 June 2005 09:53 To: [log in to unmask] Subject: Re: [data-protection] email requesting Subject Access Request Can I ask, is it lawful to ask a data subject requesting a SAR why they want it? I thought it was unlawful. What is confusing me is when we clarify what the person is looking by perhaps asking "what exactly are you looking for?", does that not in effect give some light on why the person wants it? Does this make sense? Obviously you may wish to clarify what the person is looking for and you may need to get them to establish their identity, but the basic request seems valid to me. The pdf is signed and has been scanned in. The cheque for the fee has apparently been sent separately. We have a form which we normally send out for completion so are we within our rights to ask that this be completed before proceeding ? I realise that an email request for FOI is valid and the email has been sent on to our FOI dept for them to deal with the parts that apply to them. ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^ All archives of messages are stored permanently and are available to the world wide web community at large at http://www.jiscmail.ac.uk/lists/data-protection.html If you wish to leave this list please send the command leave data-protection to [log in to unmask] All user commands can be found at : - http://www.jiscmail.ac.uk/help/commandref.htm Any queries about sending or receiving message please send to the list owner [log in to unmask] (all commands go to [log in to unmask] not the list please) ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^ The information in this email is solely for the intended recipients.
