There was an exchange in this discussion group in 2002 about the links between the JISC Plagiarism Detection Service and the DPA (see particularly archive messages 010695 and 010715, but also 007478 and 007507). There seemed to be a view at that stage, that the Data Protection Commissioner had specifically ruled that universities could not submit students' work for plagiarism detection, unless the individual student had agreed that this could be done (evidently making a nonsense of the idea), and also that it was not "reasonable" for institutions to make an agreement that work could be submitted to such a check a condition of being a student. What I have not been able to establish (as a new member of this discussion group), is whether things have moved on since then and whether (a) if the original view was the result of a specific enquiry of the Commissioner, the view has changed; (b) it is not accepted as "reasonable" that we make it a condition of registration. Has anyone gone ahead and made such consent a condition of studentship? If so, are they feeling secure in doing that? Advice on an approved formula or way forward gratefully received!
