You are right in your thinking but only where the organisation holding the manual file is not a public authority. The Freedom of Information Act has extended the definition of data in the Data protection Act to include a fifth category of data which includes totally unstructured data and data that is filed in a system that is not as structured as a relevant filing system. However, thi samendment is only applicable where the organisation is a public authority.
