I presume that this "our AUP cannot be enforced" simply means that the AUP has no legal basis and therefore you could not prosecute anyone for breaching it. I agree with this and we use our AUP with this in mind. Given that (virtually) no-one actually reads the AUP before clicking to agree to it all that it is useful for is pointing out why a person is judged to have breached it after the act (and countering claims of "I didn't know that was not allowed" or the defence of ignorance).

It would be interesting to know from where or from who you were "recently ... informed that ... we have no right whatsoever to block access to any site unless it has illegal content" as this is quite clearly nonsense from where I am standing.

We have been using an Acceptable Use Policy in our ICT centres since the implementation of the People's Network and all users sign to say that they agree to the terms and conditions laid out in the policy.  They are essentially agreeing not to (amongst other things) "create, access or distribute material which is obscene, racist, defamatory or illegal or cause harassment or gross offence to others. This includes violence, pornography, hate mail and abusive forms of marketing and material which could incite any form of hatred or discrimination."  We drew up our AUP in accordance with MLA (Resource) guidelines and our own legal department checked it over for us.  
We have often had to use the AUP to draw people's attention to what is deemed unacceptable usage of the internet in a public library environment.  
However, we have recently been informed that our AUP cannot be enforced and we have no right whatsoever to block access to any site unless it has illegal content (based on police/legal definition).    
I would be interested to know your views on this - particularly if you are using an AUP and how you enforce it.  Please respond direct to my email and I can summarise for the list at a later date.
