I would also be interested, to know what is the right way of proceeding if the only consent has been to release the info to the individuals solicitor, and our solicitors then request a copy of the same info, do they have to get consent as well, or should they be contacting the employees solicitor, or what? We have the added problem in Guernsey that the Medical Records Act has never applied, and the DDA has only recently been introduced, so there is quite a bit of confusion.

 

I would appreciate some advice as well.

I will reply to you from work tomorrow as I have been to a Tribunal with the same issues almost. Do not release to your management, give them a copy of the RCN document which I can also email you and I will tell you what happened to me
