The other thing is that the courts have said that, although Durant may have rendered certain information outside the DPA rules, it may then have to be made available under the discovery rules if the person takes the organisation to court under the DPA. Surely it is easier just to make the file available?

In my opinion you were advised quite correctly, but the route through the
courts to access EU law from within the UK generally includes the British
Legal System, and the UK courts system will need to include Durant in any
considerations.
