My view is that we are getting a little tied up in "removal" of the data. If
it's simply "you are sending me junk, delete my details" then fine. However
we are talking here (in the *fun* example) about a crime being committed. An
individual has the right to have inaccurate data corrected, but not
necessarily removed (DPA states that data controller may be ordered to
rectify, block, erase or destroy data). I personally would want the data
amending (rectify) to state unambiguously that my name was linked by
mistake, but I would not necessarily want them removing - it may be the only
record of me being innocent and as I mentioned in my last post, if it is
deleted what is to stop the same thing happening again?

Also as Roland rightly pointed out, an audit trail must reflect changes and
so the data would remain in some form. The important thing is ensuring that
the data are now accurate, and in this instance I would argue accurate could
mean data appended to the orginal erroneous information.

But harking back to the other thread, how do you know that the removal was
done correctly unless there's an audit trail, and *that* audit trail will
have to include the fact that there was an offence (otherwise the audit
trail will describe a transaction regarding an unknown quantity, and be of
no use at all); and so the data lives on for ever!
