For the last three years we have been working hard on persuading key technology providers that compliance with information law and privacy e.g. Data Protection Act 1998 (particularly SARs) could be a market differentiator, a Unique Selling Point (USP). If compliance were provided 'out-of-the-box' Ben would be able to push shift-F5 to deliver a full, redacted SAR report on the data subject. OK, it's not quite as easy as that, but some fairly complex SQL search queries have been written in the name of data mining, customer lifetime value, and all things CRM. The same programming talent could be applied to SARs et al. Our analysis of the current UK situation is that because punitive damages are too low, there is too little of the 'S' in USP. We are however making progress with global solution providers, who have clients in much harsher regimes, where financial damages for non-compliance are very real.
