This is information which concerns the health of the other child and I would have thought it could be released under Schedule 3 3(b) of the DPA (1998): 'The processing [which includes disclosure] is necessary - in order to protect the vital interests of another person, in a case where consent by or on behalf of the data subject has been unreasonably withheld.' And Schedule 3 8(1 and 2) covers processing for medical purposes. Personally I'd get physical if someone didn't tell me something that concerns the health of my son - whether or not it is currently terminal I'd want the opportunity to research into it for myself in case there was a breakthrough somewhere in the world!
