Is public relations the same as journalism? If the PR department is acting as the mouthpiece of the local authority, then it may have difficulty demonstrating that what it is engaged in is "journalism" even if the output appears in the form of a newsletter. More importantly, section 32(1)(b) limits the exemption to cases where "having regard in particular to the special importance of the public interest in freedom of expression, publication would be in the public interest". What kind of story is a local authority PR department likely to put out that (a) qualifies as journalism rather than PR and (b) merits special protection because of the public interest in freedom of expression?
